Welcome to A Pound of Cure, an app owned and operated by Digital Bariatrics, LLC ("we," "our," or "us"), located at 5155 E Farness Dr, Suite #111B, Tucson, AZ 85712.

These Terms of Use ("Terms") govern your access to and use of the A Pound of Cure mobile and web application, and any services, features, or content offered through it (collectively, the "App"). By accessing or using the App, you agree to be bound by these Terms.

1. Eligibility and Account Information

You must be at least 18 years old to use the App. You agree to provide accurate information when creating an account and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

2. Services Provided

The App provides:

• Nutritional counseling by a licensed Registered Dietitian

• AI-guided nutritional advice and strategy

• Food logging tools and analytics

• Educational videos

• A moderated community forum for user interaction

The App is available to users in the United States, Canada, United Kingdom, and Australia.

3. Free and Paid Versions

We offer a free version of the App that includes limited AI credits each month. Additional features may require a paid subscription. Subscription pricing and features are subject to change. Refunds are only issued for duplicate payments or billing errors.

4. No Medical Advice

The App provides educational content and general health and nutrition guidance. It does not provide medical advice or treatment. Always consult a licensed physician before making any medical or health-related decisions. Your use of the App does not establish a doctor-patient relationship.

5. Community Guidelines

You may post content in forums and comment sections. By doing so, you agree to abide by our Community Guidelines, which prohibit offensive, abusive, or harmful content. We reserve the right to moderate, edit, or remove content at our sole discretion and to suspend or terminate accounts that violate these terms.

6. Intellectual Property

All content, features, and functionality on the App—including text, graphics, logos, software, and trademarks—are owned by Digital Bariatrics, LLC or its licensors. You may not reproduce, modify, or distribute any part of the App without express written permission.

7. Modifications

We may update these Terms at any time. Changes are effective upon posting. Continued use of the App constitutes your acceptance of the updated Terms. You are responsible for reviewing these Terms periodically.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or free from harmful components. Your use of the App is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, punitive, or consequential damages arising out of your use or inability to use the App. In no event shall our total liability exceed the amount paid by you (if any) in the three months prior to the claim.

10. Arbitration and Governing Law

Any disputes arising under these Terms will be resolved through binding arbitration under the rules of the American Arbitration Association, to take place in Tucson, Arizona. You waive any right to a jury trial or to participate in a class action. These Terms shall be governed by the laws of the State of Arizona.
